2. Definitions

• "Client" or "User": Refers to the individual or entity utilizing our Services.
• "Thread": Refers to a concurrent connection allowing for the simultaneous solving of a captcha. Your subscription tier dictates the maximum number of concurrent threads available to you.
• "Digital Content": Data which are produced and supplied in digital form (e.g., the API response).

3. Eligibility and Account Security

• Age Requirement: You must be at least 18 years old or the age of majority in your jurisdiction to use our Services.
• Account Security: You are responsible for maintaining the confidentiality of your API keys and login credentials. You are fully responsible for all activities that occur under your account.
• KYC & Verification: We reserve the right to request identity verification (Know Your Customer) if we detect suspicious activity. Failure to provide such verification may result in account suspension.

4. Acceptable Use Policy (Strict Liability)

This is a tool for automation and testing. You are solely responsible for ensuring your use of CaptchaSolv complies with all applicable laws.

You agree NOT to use the Services for:

• Illegal Activities: Engaging in cybercrime, fraud, hacking, cracking, credential stuffing, or unauthorized access to any system.
• DDoS: Launching Distributed Denial of Service attacks.
• Ad Fraud: Engaging in click fraud or manipulating advertising metrics.
• Spam: Facilitating the sending of unsolicited bulk messages or creating fake accounts in bulk on third-party platforms in violation of their terms.
• Reselling: You may not resell, sublicense, or redistribute our Services without a specific written agreement from us.

Compliance Statement: We do not monitor the specific websites you target. However, if we receive a valid abuse report or legal order regarding your account, we will suspend services immediately. You agree to indemnify and hold CaptchaSolv harmless from any claims arising from your violation of third-party terms of service or local laws.

5. Subscriptions, Payment, and Renewals

Unlike credit-based systems, CaptchaSolv operates on a Fixed Monthly Resource Model (Pay-per-thread).

• Billing Cycle: Services are billed in advance on a monthly basis. The "Starter," "Basic," "Pro," and "Enterprise" plans grant access to a specific number of threads for 30 days.
• Automatic Renewal: By default, your subscription will automatically renew at the end of the billing period to ensure uninterrupted service. You may cancel auto-renewal at any time from your dashboard.
• Upgrades: Upgrades take effect immediately, with a pro-rated charge for the remainder of the cycle.
• Downgrades: Downgrades take effect at the start of the next billing cycle.
• Currency: All fees are charged in USD unless otherwise stated.

6. Refund Policy and Right of Withdrawal (EU Consumers)

Business Customers (B2B): All sales are final. We do not offer refunds for partial months, unused threads, or if you fail to use the service.

EU Consumers (Right of Withdrawal Waiver): Under EU Directive 2011/83/EU, consumers typically have a 14-day right of withdrawal. However, you acknowledge and expressly agree that the supply of our Services (digital content and immediate access to API threads) begins immediately upon purchase.

BY PURCHASING A SUBSCRIPTION, YOU EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THE CONTRACT AND ACKNOWLEDGE THAT YOU THEREBY LOSE YOUR RIGHT OF WITHDRAWAL.

Service Incompatibility: We do not offer refunds if our Service is incompatible with your specific third-party software, scripts, or if a specific target website changes its security measures preventing the Service from working.

7. Service Availability and Disclaimers

"As Is" Basis: The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties, whether express or implied, including fitness for a particular purpose.

Third-Party Dependencies: Our ability to solve captchas depends on third-party technologies (e.g., Google reCAPTCHA, Cloudflare, GeeTest). These providers update their systems frequently. We do not guarantee 100% success rates or 100% uptime. A change in a third-party algorithm may temporarily reduce success rates; this is not grounds for a refund.

Maintenance: We reserve the right to temporarily suspend services for maintenance or upgrades.

8. Limitation of Liability

To the maximum extent permitted by applicable law (including EU Consumer Law):

• Cap on Liability: In no event shall CaptchaSolv, its directors, employees, or agents be liable to you for any indirect, incidental, special, punitive, or consequential damages. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the one (1) month prior to the event giving rise to the liability.
• User Actions: We are not liable for any consequences resulting from your use of the solved captcha tokens, including account bans on third-party websites or legal actions taken against you by third parties.

9. Intellectual Property

• Our IP: All rights, title, and interest in and to the CaptchaSolv platform, API, and software remain exclusively ours.
• User Data: We lay no claim to the data you process through our API, except as necessary to provide the Service (e.g., analyzing captcha images to return a solution).

10. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if:

• You breach these Terms (specifically the Acceptable Use Policy).
• We are required to do so by law.
• Your usage patterns threaten the stability of our infrastructure.

Upon termination for breach, you forfeit any remaining subscription time.

11. Dispute Resolution and Governing Law

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
• Amicable Resolution: For any dispute, you agree to first contact us at [email protected] and attempt to resolve the issue informally for at least 30 days.
• ODR Platform (EU Only): If you are a consumer residing in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform: http://ec.europa.eu/consumers/odr/

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or a prominent notice on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
